Von Miller faces up to a six-game suspension for violation of the league’s substance abuse policy, while negotiations are being held to reduce the ban to four games. Representations of Miller are working on these negotiations according to league sources.
The test that prompted the suspension was flagged for a “diluted sample.” This occurred when Miller was asked to give a test before an offseason practice/workout and the sample was spilled before being given to the collector. Miller spilled the sample himself and was then asked to give another sample and he could not.
Miller then participated in the practice while drinking fluids throughout. Afterwards he provided a sample that was used in the test. It is unlikely Miller will go ahead with an appeal although both sides were trying to settle the suspension’s conditions.
This is not the first time Miller has tested positive. At the meeting Thursday with NFLPA officials, sources say discussions were held whether or not to dispute his positive test from 2011 as part of Miller’s appeal. He tested positive for marijuana and amphetamines during the NFL lockout.
The official announcement determining the number of games is likely to come this week.
